DISTANCE SALES AGREEMENT

This Distance Sales Agreement (“Agreement”) is entered into between Eylül Alıcıoğlu (“Seller”) and the person purchasing products through eylulalicioglu.com (“Buyer” or “Consumer”).

2. SUBJECT OF THE AGREEMENT

This Agreement governs the sale and delivery of handmade wall sculptures and other handmade artistic works offered for sale through eylulalicioglu.com.

Each product is handmade individually. Minor variations in texture, form, colour and finish may naturally occur and are considered characteristics of handmade artwork rather than defects.

3. ORDER AND CONTRACT FORMATION

The Buyer selects the desired product, provides the required information, chooses the available payment and delivery options, and completes the order through the website.

The Agreement becomes effective once the order has been successfully placed and payment has been received.

An electronic confirmation of the order may be sent to the email address provided by the Buyer.

4. PRODUCT INFORMATION AND PRICE

The essential characteristics, dimensions, materials and price of each product are displayed on the relevant product page.

All prices displayed on the website are stated in the currency indicated on the website and include applicable taxes and charges where legally required.

Shipping costs, if applicable, are displayed before the completion of the order.

5. PAYMENT

Payments made through the website are processed through the payment infrastructure available on the website, including iyzico where applicable.

The Seller does not store the Buyer's full card details.

The order will be processed after successful payment confirmation.

6. DELIVERY

For deliveries within Türkiye, the Seller aims to dispatch and deliver standard, ready-to-ship products within 7 days from the date of order confirmation, subject to the availability of the product and circumstances beyond the Seller's reasonable control.

For international orders, delivery times may vary depending on the destination country, customs procedures, selected carrier and other circumstances outside the Seller's control.

The Buyer is responsible for providing a complete and accurate delivery address.

Any customs duties, import taxes or similar charges imposed by the destination country on international shipments are the responsibility of the Buyer unless otherwise expressly stated on the product or checkout page.

7. HANDMADE PRODUCTS

The Buyer acknowledges that the products are handmade artworks.

Natural and intentional variations in:

shape,
texture,
colour,
brushwork,
surface,
dimensions within reasonable handmade tolerances,

do not constitute defects when they are consistent with the handmade nature of the work.

8. CUSTOM AND COMMISSIONED WORKS

Certain works may be produced according to the Buyer's individual specifications, including but not limited to:

custom dimensions,
custom colours,
custom forms,
custom compositions,
other specifications agreed between the Buyer and Seller.

Before production begins, the agreed specifications and price will be confirmed with the Buyer.

Because commissioned works are produced according to the Buyer's individual requirements, they may fall within the legal exception applicable to goods prepared according to the consumer's wishes or personal needs.

9. RIGHT OF WITHDRAWAL

For standard products that are not subject to a statutory exception, the Consumer has the right to withdraw from the Agreement within 14 days without giving a reason, subject to the applicable provisions of Turkish consumer law.

The withdrawal period generally begins on the date on which the Consumer or a person designated by the Consumer receives the product.

The right of withdrawal does not apply to goods that are prepared according to the Consumer's wishes or clearly personal needs, to the extent that the statutory exception applies.

Accordingly, custom-made works produced specifically according to the Buyer's requested dimensions, colours, forms or other personal specifications may not be eligible for withdrawal.

Nothing in this Agreement shall be interpreted as limiting any mandatory rights granted to consumers under applicable law.

10. RETURNS AND REFUNDS

Where a valid right of withdrawal applies, the Buyer must return the product in accordance with the applicable legal requirements and the return instructions provided by the Seller.

Refunds will be made using the same payment method used for the original transaction, unless otherwise agreed or required by law.

The Seller reserves the right to assess returned products in accordance with applicable consumer legislation.

11. DAMAGED PRODUCTS

If a product arrives visibly damaged, the Buyer is encouraged to document the condition of the package and product with photographs and contact the Seller as soon as possible at:

The Seller will assess the situation and provide the appropriate solution in accordance with applicable law.

12. PERSONAL DATA

Personal data provided during an order is processed in accordance with the Seller's Privacy Policy and KVKK Information Notice.

The Buyer can access the relevant information through the website's privacy section.

13. INTELLECTUAL PROPERTY

All photographs, product images, artwork, designs, written content, logos and other visual materials appearing on eylulalicioglu.com belong to Eylül Alıcıoğlu unless otherwise stated.

Purchasing a physical artwork does not transfer copyright or other intellectual property rights in the artwork to the Buyer.

14. GOVERNING LAW

This Agreement is governed by the laws of the Republic of Türkiye.

Mandatory consumer protection provisions applicable to the Buyer remain unaffected by this Agreement.

15. DISPUTE RESOLUTION

For consumer disputes, the competent Consumer Arbitration Committee or Consumer Court shall be determined in accordance with the applicable Turkish consumer legislation and the legally applicable monetary limits and jurisdiction rules.
